A New York man has been sentenced to 30 months in prison for selling a prescription-only erectile dysfunction (ED) prescription drug in the United States, after a federal judge rejected his request for a preliminary injunction ordering the company to take a generic version of Pfizer’s blockbuster erectile dysfunction drug. The judge ordered the pharmaceutical company to immediately cease sales of the drug, which is marketed as Viagra. Pfizer agreed to pay $2.9 million in restitution to the manufacturer, as well as a $1.6 million fine to resolve any future sales tax on the drug.
Judge Steven M. Dukisjk of the Federal Courriel, New York, sentenced a man who pleaded guilty to two counts of unlawfully selling prescription drugs, to a maximum penalty of 12 years in prison and a $250,000 fine.
The judge noted that Pfizer’s patent on the drug does not extend to generic versions of the drug. The FDA granted the injunction, stating that the drug was being sold as “Viagra for men.”
On appeal, the FDA said that the drug, which was manufactured by Pfizer, was “not a legitimate product for use in the treatment of erectile dysfunction.” The FDA also said the drug caused “physical problems in men with ED,” and that the drug should not be used in children under the age of 18.
The judge said Pfizer had purchased a generic version of the drug and had advertised it as a cheaper alternative to Viagra. It was the FDA’s decision to approve the drug.
